Brooklyn Construction Worker Killed by Reckless Driver

While there are many dangerous jobs in the construction industry, workers face considerable hazards whenever they are in close proximity to drivers. The obvious example is a traffic “flagger,” who is responsible for directing cars safely around construction sites. These workers often stand just a few feet away from fast-moving vehicles, and they are often struck. This occurred recently in Brooklyn – with fatal consequences. One can only wonder what the family of this worker is going through after such a preventable New York construction accident

Construction Flagger Crushed by Reckless Driver in Brooklyn

In October of 2024, it was reported that a construction flagger in Brooklyn had been struck and crushed to death by a reckless driver operating a white van. This worker was tasked with standing in close proximity to moving vehicles, and he was attempting to direct the drivers away from a nearby construction area. ABC News states that a white van approached the intersection at an unsafe speed before attempting a highly reckless maneuver that killed the worker.

The entire incident was caught on camera, and the footage shows how this white van tried to squeeze past another vehicle despite obviously having no space to do so. This caused the white van’s side mirror to strike the construction worker, lifting him off the ground and wedging him between two vehicles. The van then slammed on the brakes, which caused the worker to fly forward. He ultimately rolled underneath a box truck, where he was crushed to death.

The worker was wearing reflective clothing and standing behind a set of traffic cones when the accident occurred. Although he was working in close proximity to traffic, he was following all necessary safety protocols – and he was standing in an area where no vehicles should have ventured. He was just 37 years old, and he undoubtedly left behind many grieving loved ones.

The driver of the van is almost exactly the same way, and his life will likely also change forever because of this incident. He now faces charges of criminally negligent homicide, reckless endangerment, reckless driving, and “failure to exercise due care.” The investigation is ongoing, and these charges may change. He is also presumed innocent until proven guilty.

Can I Take Legal Action After My Loved One Dies in a Construction Accident?

If your loved one died in a construction accident, the first instinct may be to file a workers’ compensation claim. While death benefits can be significant, you may also have the right to file a wrongful death lawsuit against the negligent party responsible for the accident. In the case involving the construction flagger, he was clearly killed by a reckless driver – and the family may be able to sue the driver directly.

This could provide more compensation compared to a workers’ compensation claim, which does not cover non-economic damages. In addition, the fact that the reckless driver was operating a white van implies that he was working while this accident occurred. It may also be possible to sue the company that owns/operates the white van, and this could lead to even more compensation.
