Scaffold Law Under Threat Once Again as Gateway Project Moves Forward

Everyone who knows anything about New York’s construction industry understands that the Scaffold Law is constantly under threat. This time-honored piece of legislation has been attacked on all sides by corporate groups, wealthy developers, and corrupt politicians for decades. But it has stood the test of time, and this is certainly a victory for the average construction worker in New York. Because of the Scaffold Law, New York construction workers enjoy greater legal protections and safety standards compared to those of virtually any other state.

Unfortunately, the Scaffold Law is under threat once again. Previously, critics argued that it should be eliminated because of the legalization of marijuana. Now, they are telling New Yorkers that this law is no longer needed as we approach the extensive, ambitious Gateway Project. If the Scaffold Law is indeed eliminated, those who are about to work on this project may have little legal recourse if they become injured on the job.

If you have been injured in a New York construction accident, it’s important to reach out to a qualified, experienced personal injury attorney as soon as possible. Our legal professionals can help you recover compensation for your medical expenses, missed wages, and any other out-of-pocket expenses you might have incurred as a result of your workplace accident. Scaffold Law or not, every worker deserves the right to hold negligent parties accountable if they suffered an on-the-job injury due to someone else’s recklessness.

Why is the Gateway Project Threatening the Scaffold Law?

The Scaffold Law states that contractors and property owners have “absolute liability” for all “gravity-related accidents” on construction sites in New York. The law is well over 100 years old, and it has led to considerable settlements for injured workers across the Empire State. With massive payouts going to needy and injured workers, it should come as no surprise that wealthy and powerful organizations within the construction industry have lobbied to have this law removed for decades.

The latest threat to the Scaffold Law has arisen in relation to the Gateway Project. This project has been in development for quite some time, and it would revitalize the city’s rail infrastructure. It is an ambitious project, and it is also expensive. To date, officials in both New Jersey and New York have sought billions of dollars in funding for this undertaking.

In their effort to cut costs, these organizations have set their eyes upon the elimination of the Scaffold Law. In April of 2021, it was reported that several organizations representing contractors and mayors had written a letter to Transportation Secretary Pete Buttigieg, urging him to “override” the Scaffold Law in preparation for the Gateway Project.
